The Website and its Content is owned by Better Habits LLC (“Company”, "we," "us," or "our"). The term “you” refers to the user or viewer of getbetterhabits.com (“Website”).

2. Information We Collect

This website is hosted by Squarespace. Squarespace collects personal data when you visit this website, including information about your browser, network, and device, web pages you visited before coming to this website, web pages you view while on this website, and your IP address. Squarespace needs the data to run this website and to protect and improve its platform and services. Squarespace analyzes the data in a de-personalized form.

We collect personal information from you so that we can provide you with a positive experience when utilizing our Website or content.  We will only collect the minimum amount of information necessary for us to fulfill our obligation to you. We may collect:

  • A name and an email address so we can deliver our newsletter to you – you would be affirmatively consenting to this by providing this to us in our contact forms.

  • Billing information including name, address and credit card information so that we can process payment to deliver our products or services to you under our contractual obligation.

We share this information with Squarespace, our online store hosting provider, so that they can provide website services to us. We may also collect non-personal information, including your IP address, browser type, previous websites visited, and device information through our service providers Squarespace and Squarespace Payments to analyze usage and other trends to provide you with a quality customer experience during your visit and checkout. When you subscribe and purchase a membership on our website, we collect personal information from you to enable your member site access. This may include billing and shipping address, details relating to your subscription, email address, name, and phone number.

Our website includes commenting functionality on some pages which enables you to post a comment. Our website collects personal data when you post a comment, including your name; your email address (optional); and your website URL (optional). Our website includes “likes” functionality on some blog posts which enables you to “like” a post. When you schedule an appointment by booking on our website, we collect personal information from you to complete the booking. We may collect information like name, email address, phone number, details relating to your appointment, and files you uploaded. We share this information with Squarespace (Acuity Scheduling), our scheduling service provider, so that they can provide online booking services to us.

When you make a purchase from us on this website, we use Squarespace Payments as our payment solution. Squarespace Payments is a fully integrated, native payment solution provided to us by our online store service provider Squarespace. Squarespace Payments makes use of the following third-party service providers which will also receive your personal information and process it in accordance with their privacy policies:

3. How We Use Your Information

We use the information we collect to provide and improve our services, communicate with you, process payments, and personalize your experience. We may also use your information for marketing purposes with your consent. Our payment processor, Squarespace Payments, will also collect payment information from you. As you go through checkout, this site may auto-complete your shipping and billing address by sharing what you type with the Google Places API and returning suggestions to you to improve your checkout experience. We share member site access information with Squarespace, our website hosting provider, so that they can provide exclusive member site hosting services to us. We only use third-party payment processors that take the utmost care in securing data and comply with the GDPR.

Contact You. We may contact you with information that you provide to us based on these lawful grounds for processing:

  • Consent. We may contact you if you give us your clear, unambiguous, affirmative consent to contact you.

  • Contract. We will contact you under our contractual obligation to deliver goods or services you purchase from us.

We do share this information with Squarespace, our website analytics provider, to learn about site traffic and activity.

We do share this information with trusted third parties, such as our newsletter provider in order to contact you via email, our merchant accounts to process payments, and Google/social media accounts in order to run advertisements and our affiliates.

Viewing by Others. Note that whenever you voluntarily make your Personal Data available for viewing by others online through this Website or its Content, it may be seen, collected, and used by others, and therefore, we cannot be responsible for any unauthorized or improper use of the information that you voluntarily share (i.e., sharing a comment on a blog post, posting in a Facebook group that we manage, sharing details on a group coaching call, etc.).

We do not set any personally identifiable information in cookies, nor do we employ any data-capture mechanisms on our Website other than cookies. We are the data controllers as we are collecting and using your Personal Data.  We use trusted third parties as our data processors for technical and organizational purposes, including for payments and email marketing. We use reasonable efforts to make sure our data processors are GDPR-compliant.

15. Dispute Resolution

We hope that if we ever have any differences, we can work them out amiably through e-mail correspondence. However, should a dispute ever arise between us, we agree now that we will submit to binding arbitration before a single arbitrator, selected jointly, in accordance with the American Arbitration Association Rules. Any judgment on an arbitrator’s award, if made, is binding and may be entered into any court having the appropriate jurisdiction. Prior to seeking arbitration, you must submit your concerns to Better Habits LLC via e-mail in an attempt to resolve the situation prior to resorting to arbitration. By agreeing to this Privacy Policy, you agree to a modification of the statute of limitations such that any arbitration must be commenced within one year of the date of the act, omission, or other conduct complained of as submitted by you in e-mail or shall otherwise be forfeited forever. You also agree that should arbitration take place, it will be held in Alexandria City County, Virginia, and the prevailing party shall be entitled to all reasonable attorney’s fees and costs necessary to enforce the Agreement. These terms and conditions shall be construed according to the laws of the State of Virginia. If this terms and conditions, or any part therein, is construed to be invalid or unenforceable, it shall not affect the validity or enforceability of the remainder of the terms and conditions, which shall be given full force and effect.
